Fugitive From Justice
Legal Definition
A person is a fugitive from justice when they have been charged with or convicted of a crime in another jurisdiction and have fled that jurisdiction to avoid prosecution or punishment. New Mexico law authorizes the arrest and detention of fugitives pending extradition proceedings to return them to the demanding state. This is not an independent substantive offense but rather a procedural status that permits arrest on an out-of-state warrant under the Uniform Criminal Extradition Act.
Possible Punishment
No independent penalty is imposed for fugitive status itself. The individual is held in custody pending extradition to the demanding jurisdiction, where they will face the penalties associated with the underlying charge or conviction. New Mexico law permits detention for a reasonable time while extradition documents are processed and the governor issues a warrant of extradition.
Local Context
This charge code reflects an arrest on an out-of-state warrant, not a New Mexico criminal offense. The Uniform Criminal Extradition Act (§§ 31-4-1 to 31-4-29 NMSA) governs the process. The individual may contest extradition through a hearing, but New Mexico courts do not adjudicate guilt on the underlying charge. If extradition is granted, the person is transported to the demanding state to answer the original charge.
